In general, family law judges are reluctant to approve of an international relocation petition unless it can be shown that the child will not be harmed by the separation from immediate contact with the other parent. Such considerations include:

  • Does the culture provide educational and social opportunities that will enhance the child’s well-being?

  • Will the relocation result in a diminished income or standard of living for the custodial parent and child?

  • Will the non-custodial parent have the legal right and opportunity to visit the child in the country of relocation?

  • Will travel restrictions prevent the custodial child from making regular visits to the United States for time with the non-custodial parent?
