Dutchess County Traffic Ticket Lawyers

Dutchess County

Located in the Hudson Valley, Route 9, Route 44, Route 55, and the Taconic State Parkway run through Dutchess County and are the main thoroughfares for traffic in New York State.

Dutchess County is known to truck drivers, locals, and tourists alike for the many historic attractions, fall foliage, and colleges such as Vassar College, Marist College, and the Culinary Institute of America.

The Taconic State Parkway, highways in Dutchess County, and recreational attractions in the area generate considerable traffic, which leads to a large number of traffic tickets being issued.

Law enforcement agents that monitor these highways in New York include police, sheriffs, and state troopers.

Some of the most common traffic violations in Dutchess County, NY, include moving violations and driving while intoxicated (DWI). But there are many more traffic tickets, CDL violations, misdemeanors, and other criminal offenses that come through these courts.

State troopers write most of these tickets, and apart from speeding, other common offenses include:

  • Speeding
  • Distracting lights
  • Brake light issues
  • Improper or expired registration
  • Driving without a license
  • Driving with a suspended license
  • Unlawful lane change
  • Running a red light
  • Running a stop sign
  • Aggravated unlicensed operation

Simply paying the fine for a traffic ticket is as good as an admission of guilt. Our attorneys may be able to challenge the ticket with prosecutors in court – without you having to appear.

Receiving a ticket for a traffic violation while driving through New York State – even while on vacation – could mean that you are required to attend court here.

Traveling to court is a pain. It can also be expensive.

Whether you’re a local driver or are visiting New York State from another state, when you receive a traffic ticket on the Taconic State Parkway, Route 44, Route 55, or Route 9, when you simply pay the ticket, you are pleading guilty. This traffic violation conviction remains on your permanent record and may have additional negative consequences in the future.

An experienced traffic violation lawyer representing you not only saves the hassle of attending court. You also have a much better chance of escaping the consequences of the ticket - which can be severe and include not only financial penalties but a potential criminal record.

Whether you live out of the county, out of New York State, or even if you are based in Canada, our traffic attorneys will advise you of your options, represent you in court, and protect your interests, regardless of which county issued your ticket.

Receive a traffic or speeding ticket in Dutchess County and don’t want to attend court?

There is one main court for each of the counties of New York State. Regardless of the city in which you receive your ticket, it will be issued by the Dutchess County Court, 10 Market Street, Poughkeepsie, 12601.

The court indicated on your traffic violation ticket will indicate which court you need to appear in if you want to challenge your ticket without legal representation.

For most people who received traffic or speeding tickets in New York while passing through, this is extremely inconvenient. So, once we have discussed your case in our initial free case evaluation and agreed to challenge your traffic violation, we will get to work on defending you against the ticket and look after all necessary court hearings for you.

Don’t plead guilty until we talk

For out-of-state drivers, it can often seem simpler to plead guilty, pay the fine, and move on after receiving a traffic ticket in New York – even if they believe they have done nothing wrong.

Traffic violations might not carry jail sentences, and fines may be limited. Still, points can accumulate on your driving record, and your insurance rates can skyrocket, especially if you already have other violations.

In some cases, your license can be suspended and your driving privileges removed.

But did you know that many people are wrongly charged with traffic violations in New York, and others have legitimate defenses?

Incorrectly issued tickets should be challenged. The problem is that it can seem daunting without legal assistance. It may seem expensive, time-consuming, and stressful. Many drivers cave in, accept their fate and pay the fine.

Remember, paying a fine for a traffic violation is the same as pleading guilty. And once you plead guilty, you can’t change your plea later.

Never plead guilty until you’ve spoken to our knowledgeable team.

How can our traffic ticket lawyers help?

Jonathan D. Katz has almost four decades of experience practicing law, much of it helping those charged with traffic violations and traffic-related crimes all around New York State.

He also has a strong background in defending clients accused of drunk driving in and out of the courtroom. Consequently, our team understands the local courts. We know the people and the procedures, and this puts us in a strong position to fight your traffic ticket.

Most people struggle to navigate the complexities of the New York legal system and are not equipped to challenge the traffic ticket they have received. We take that burden off you and fight to get the violation dropped or reduced without you having to step foot in a courtroom.

For you, this can mean:

  • NO court appearance
  • NO points on your license
  • NO negative impact on your insurance
  • NO loss of a clean driving record
  • NO criminal record

Which traffic violation charges can we help you with?

Over the past few decades, Jonathan Katz Law has helped thousands of clients fight many types of traffic tickets and restore their driving records.

Make sure to read your ticket and respond by Mail or In Person. The court address is included on your New York State-Issued traffic ticket. You will only know how much the potential fine is after the court receives your ticket or at the time of your court appearance.

Typically, we can help you with the following types of violations:

Speeding tickets

Speeding violations in NY carry significant penalties, including heavy fines and traffic violation points ranging from 3 to 11 points, depending on how far over the speed limit you are accused of driving.

A traffic ticket for speeding in a work zone can also be quite costly.

A driver who accumulates 11 or more motor vehicle violation “points” on their license within an 18-month period risks having their driving privileges suspended.

It may be possible for our experienced speeding ticket attorney to challenge the violation based on the equipment used, the weather conditions at the time, or an error in police procedure.

High-speed ticket

Points on your license and the cost of excessive speeding in NY add up very quickly and can lead to an immediate suspension of your driver’s license.

NYS speeding ticket fines vary depending on the violation.

If you are caught driving 21-30 mph over the speed limit, six points are added. Eight points are added for 31-40 mph over the limit and 11 points for 40 mph or more over the limit.

We may be able to challenge the ticket based on the equipment used, the weather conditions at the time, or an error in police procedure.

Cell phone tickets

Cell phone tickets for distracted driving on highways have become increasingly common as we rely more on our phones. This type of violation is now more common than traditional distracted driving tickets for drinking, eating, reading, or applying makeup while driving.

Sometimes, there is a good reason for having to use a cell phone while driving (e.g., in an emergency). At other times, law enforcement officers are incorrect in their assumptions, don’t have the evidence, or have constitutional rights breached.

Driving without insurance

If you drive a car, truck, motorcycle, bus, or another commercial vehicle in New York State, you must have a paid-up current insurance policy in place at all times.

If you are stopped by police and cannot show such insurance, you can face stiff financial penalties, driving penalties, and a criminal record.

It is important to defend yourself against this violation if there is a good reason why you had no insurance or mitigating factors are present. We help you do that.

Driving without a license in NY

If you don’t have your license when you get pulled over, consequences are imminent. These consequences depend on the type of infraction.

  • Failing to show proof of your license
  • Driving without ever having a license
  • Driving with an expired license
  • Driving with a suspended or revoked license
  • Your car being driven by an unlicensed driver

If you’ve been charged with driving without a license, don’t lose your driving privileges! We’re here to help you get back on the road.

Suspension/Revocation of license

A suspended or revoked license in New York can be a harsh price to pay for a traffic violation.

Your driving privileges will be taken away, and if you continue to drive after having a suspended license in NY – even once – and are caught by law enforcement, you could face a criminal charge with up to six months in jail.

We have experience in multiple strategies to ensure that drivers threatened with license suspension or revocation are back on the roads as soon as possible.

CDL traffic violations

Commercial Drivers License tickets can have serious consequences for both the individual and the company concerned.

Choose a CDL traffic ticket attorney who knows the local courts!

Many trucking companies take responsibility for drivers’ tickets and may want to challenge these. We can manage the entire process from start to finish, whether it is a speeding violation, equipment violation, logbook violation, overweight violation, unsecured load, or any other CDL ticket.

Getting a traffic ticket could put you at risk of losing your job or, even worse, losing your CDL license.

If you have a history of traffic tickets, you can get a CDL with traffic tickets in New York, but you should know your limits before taking steps to get a CDL license.

Repeat offenders

Fighting traffic violations can be more challenging for repeat offenders – and the stakes are usually higher.

For repeated violations, significant fines, community service, license suspension or revocation, points on your license, and even jail time are possible. This is not to mention the insurance premium hikes that often result.

In this situation, you need an experienced traffic ticket lawyer who knows the local system to defend your rights and protect your driving privileges.

Toll Violations

EZ Pass Toll Violations can be expensive. It is not uncommon to see these violations in error. If you feel that you received a traffic violation in error, you are encouraged to call us so we can help you navigate this issue. The NYS Thruway Authority encourages you also to contact E-ZPass Customer Service Center, P.O. Box 15186, Albany, NY 12212, or call 1-800-333-8655 to contact them directly.

Client Reviews
★★★★★
I was living a nightmare of being falsely accused in a judicial system that considers all fathers to be dead beat dads until proven innocent. Living out of state and facing the possibility of jail, I miraculously found Jon’s website and called his office. Within a week the tables were turned, the lies were exposed, and the harassment was stopped. If you need someone that will challenge the system, then you need Jonathan Katz. Greg Weaver
★★★★★
Jon’s integrity towards his clients is what makes him a standout attorney. He makes it a priority to know what's important to you. You’re not just a number. He is upfront with you right from the start. He will not string you along just for his financial benefit. He is only willing to settle the case if that's truly what you want. Anytime I called him I received a call back from him that day. Not someone else in the office. He is an attorney that has a passion for what's important to his clients. John Morrissey
