JONATHAN KATZ: I have a relatively more sophisticated approach to custody and visitation cases utilizing expert witnesses, psychologists. Because we often have a psychologist involved in the beginning of the case it helps also to alleviate some of the parent's concerns, some worries they may have about the other parent and things that are going on with the children.
What people are concerned with when they're breaking up are two things. One is they're talking about decision making authority regarding the children and typically here that's going to be joint legal in which the parents share in the decision making for religious, educational and medical decisions. And then there's a question as to where the children will primarily live. Sometimes it's equal and sometimes it's not.
My goal is to make sure that you have the custodial relationship with your children that you want. From my perspective the case has to be prepared from the beginning as if it was going to go to trial. Most don't, but you have to be ready to do that in order to get what it is that you want in terms of your relationship with the children.
