JONATHAN KATZ: The division of property in New York is called equitable distribution. But equitable distribution does not mean equal distribution. Oftentimes it is, but you have to be careful because you may get more of an asset or get less of an asset than you're entitled to.
It's important when looking at one's assets in the context of how they'll be divided to think thoroughly and not to accept the idea that they will be divided equally.
If you are a dependent spouse, you've been a homemaker, you've been home with the children, you will be protected by receiving maintenance, and of course, if the children are still young you'll receive child support as well.
Spousal maintenance used to be called alimony and it is a payment made to one or the other spouse in order to help support them for a period of time, which could be forever, it could be for retirement, it could be for a specific period of years.
